Welcome to Fariiq ("Platform", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Fariiq platform, including our web application, mobile applications, APIs, and related services.
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
You must be at least 18 years old and have the legal capacity to enter into binding agreements. By using the Platform, you represent that you meet these requirements and that all registration information you submit is truthful and accurate.
You are responsible for ensuring your use of the Platform complies with all applicable laws and regulations in your jurisdiction.
To access the Platform, you must register an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
You are responsible for safeguarding your account credentials (passwords, PINs, and tokens). You agree to notify us immediately of any unauthorized access to your account.
Each user may maintain only one account. Creating multiple accounts may result in termination of all associated accounts.
Fariiq provides a fleet operations management platform designed for 3PL operators. Services include but are not limited to:
Access to Platform features requires an active subscription. Subscription plans are available on a monthly or annual basis, as described on our pricing page.
All fees are exclusive of applicable taxes (including VAT). Payments are processed through Stripe. You agree to provide valid payment information and authorize recurring charges.
We reserve the right to modify pricing with at least 30 days' prior notice. Continued use after the effective date constitutes acceptance of new pricing.
Late payments may result in suspension or restriction of access to the Platform. Accounts with overdue balances exceeding 30 days may be placed in read-only mode.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No prorated refunds will be issued for partial billing periods.
Upon cancellation, your data will be retained for 90 days, after which it will be permanently deleted.
We reserve the right to cancel your account if you violate these Terms, with immediate effect.
You agree to use the Platform only for lawful purposes. You must not:

Couriers accessing the Platform agree to provide accurate personal information, use the Platform only as authorized by their 3PL Company, comply with all applicable laws, and keep their login credentials secure.
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
You retain ownership of all data you upload to the Platform. We process your data as described in our Privacy Policy to provide and improve the Platform services.
Upon account termination, your data will be retained for 90 days to allow recovery, after which it will be permanently deleted.
The Platform, including its design, code, features, and branding, is owned by Fariiq and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose during your subscription term.
Any feedback, suggestions, or ideas you provide about the Platform may be used by Fariiq without obligation to you.
Both parties agree to maintain the confidentiality of any proprietary or confidential information received through the Platform. This obligation survives termination of these Terms.
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee uninterrupted or error-free service.
The Platform does not provide legal, tax, or professional advice. You are responsible for ensuring your use of the Platform complies with applicable laws.
To the maximum extent permitted by law, Fariiq shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the total fees paid by you in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Fariiq and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, your violation of these Terms, or any claims by couriers or employees managed through your account.
These Terms are effective from the date you first access the Platform. You may terminate your account at any time. We may terminate or suspend your access immediately if you breach these Terms.
Sections relating to intellectual property, limitation of liability, indemnification, confidentiality, and governing law shall survive termination.
These Terms are governed by the laws of the State of Delaware, United States. Any disputes shall first be resolved through good-faith informal negotiation for a period of 30 days.
If informal resolution fails, disputes shall be settled by binding arbitration administered by the American Arbitration Association (AAA). For users in the GCC, local consumer protection rights are preserved where required by applicable law.
You agree to waive any right to participate in class-action lawsuits or class-wide arbitration.
We may update these Terms from time to time. For material changes, we will provide at least 14 days' notice before the new terms take effect. Continued use of the Platform after the effective date constitutes acceptance.
These Terms constitute the entire agreement between you and Fariiq regarding the Platform. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not constitute a waiver.
You may not assign these Terms without our prior written consent. We may assign our rights under these Terms in connection with a merger, acquisition, or sale of assets.
In the event of conflict between translated versions, the English version shall prevail.
